Official Contest Rules

1. NO PURCHASE NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT INCREASE YOUR ODDS OF WINNING. ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.

2. Eligibility. The 105 Minute Commercial Free Workday Kickoff Cash Contest rules is open to U.S. residents, 18 years or older with a valid Texas driver's license at the time of entry. Contest is open to residents of the Arbitron San Antonio Metro signal: Atascosa, Bandera, Bexar, Comal, Guadalupe, Kendall, Medina & Wilson counties. Winners outside the San Antonio/metropolitan area are responsible for transportation to and from San Antonio to sign their release form to claim their prize. Employees of KSMG-Magic 105.3, Cox Radio, Inc., Point to Point Marketing, other radio stations in San Antonio, and each of [its/their] respective affiliated companies, subsidiaries, advertising or promotional agencies, and other agents, and the immediate family members of, and any persons domiciled with such employees, are not eligible.

3. Entry : Listen to Magic 105.3 from April 7th and through May 30th each weekday morning at approximately 7am; Magic 105.3 will announce the winning song of the day. Each day a new song will be designated as the winning song. When the designated "Song of the Day" plays (not in its entirety) between 8:30a.m. & 10:15a.m. C.S.T.-call (210) 470-KSMG (5764). The 9th (ninth) caller will be chosen as the winner of $1,000 (thousand) dollars. In addition, a second time that designated song plays, the 9th person to call in will win $1,000. The Thousand dollar song can play anytime Monday-Friday between 8:30a.m. & 10:15a.m. C.S.T.

By entering the contest, contestants give permission for their name, photo and/or voice to be used for promotional purposes without compensation. Winners must sign promotional release form as condition of receiving prize and is responsible for all taxes.

Magic 105.3 (KSMG) will not be responsible for loss of service to the call-in line or for a contestant's failure to reach the call-in line due to malfunction of any network or system, congestion, overload, busy signals, or any other factor that may prevent an individual from completing his/her phone call. In the event of interruption of power or telephone service to Magic 105.3 (KSMG) during a call-in period of 8:30a.m.-10:15a.m. C.S.T. "The 105 Minute Commercial Free Workday Kickoff Cash contest" and prior to accepting the winning caller, the call-in period affected by the interruption may or may not be replayed at the resumption of service, at Magic 105.3's sole discretion. The use of automatic telephone dialing equipment or other software or computer assisted dialing equipment is prohibited and will result in disqualification.

Prizes and Odds A total of (48) Instant "The 105 Minute Commercial Free Workday Kickoff Cash"Contest winners will receive a $1,000 check in about 6-8 weeks of winning.

Each of The 105 Minute Commercial Free Workday Kickoff Cash Contest winners are not eligible to win any contests on Magic 105.3 (KSMG) or any other Cox Radio Station, for 3 months. Additionally, $1,000 prize winner(s) can only win once during this contest; one winner per household for the entire promotion. Each $1,000 prize winner must provide all information including their Social Security Number at the time of the winning, if not they will forfeit their prize.

5. Winner Notification and Acceptance. Winners may waive their right to receive prizes are non-assignable and nontransferable. No substitutions allowed, except that prizes and individual components of prize packages are subject to availability and Magic 105.3 reserves the right to substitute prizes of equal or greater value. Winners are solely responsible for reporting and payment of any taxes on prizes. Winners will be required to complete an affidavit of eligibility, and a liability and publicity release (except where prohibited by law) which must be returned within ten (10) days of date of postmark/ date prizes is awarded. Failure to sign and return the affidavit or release within ten (10) days, or to comply with any term or condition of these Official Rules, may result in a winner's disqualification, the forfeiture of his or her interest in the prize, and the award of the prize to an alternate winner. Except where prohibited, participation in the contest constitutes entrant's consent to the publication of his or her name, biographical information and likeness in any media for any commercial or promotional purpose, without limitation or further compensation. 6. Participation. By participating, entrants agree to be bound by these Official Rules and the decisions of the judges. Magic 105.3 reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this contest as solely determined by Magic 105.3. In the event the contest is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of 99.5 KISS, which corrupts or impairs the administration, security, fairness or proper operation of the contest, Magic 105.3 reserves the right in its sole discretion to suspend, modify or terminate the contest. Should the contest be terminated prior to the stated expiration date, Magic 105.3 reserves the right to award prizes based on the entries received before the termination date.

7. Limitations of Liability. By entering the contest, entrant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with the contest, or any prizes awarded, shall be resolved individually without resort to any form of class action, and entrant waives his or her right to a jury trial for such disputes, claims, and causes of action; (2) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the contest, but in no event attorneys' fees; and (3) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.

8. Construction. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any contestant and Magic 105.3, shall be governed by, and construed in accordance with the laws of the State of Texas, without giving effect to any choice of law or conflict of law rules or provisions (whether of Texas, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Texas. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. If any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.

9. General Release. By entering the contest, contestants release KSMG-Magic 105.3, Cox Radio, Inc., Point to Point Marketing, any other promotional sponsors, and each of their respective affiliated companies, directors, officers, employees, representatives, partners and agents from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Sweepstakes or with the acceptance, possession or use of any prize (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light).

10. Sponsor. The 105 Minute Commercial Free Workday Kickoff Cash Contest is sponsored by Magic 105.3, whose decisions regarding the selection of winners and all other aspects of the contest shall be final and binding in all respects. Sponsor will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to the contest.
